1. Agreement to these terms
These Terms of Service (“Terms”) govern access to and use of Witsko (“the Service,” “we,” “us,” or “our”), an AI-powered commerce assistant that lets businesses (“Merchants”) connect messaging channels such as WhatsApp and Instagram so an automated AI assistant can talk to their customers (“End Customers”) and take orders on their behalf. By creating an account, connecting a channel, or messaging a business that uses Witsko, you agree to these Terms.
2. Who these terms apply to
- Merchants — businesses that create an account, connect a messaging channel, and configure a catalog to sell through Witsko.
- End Customers — people who message a Merchant’s connected account and interact with the AI assistant. Their use is also governed by the messaging platform’s own terms (e.g. WhatsApp, Instagram) and by the Merchant’s own policies for that transaction.
3. The Service
Witsko connects a Merchant’s messaging channels to an AI reasoning layer that answers product questions, helps configure orders, and processes checkout against pricing and inventory the Merchant provides. Order totals, item pricing, and stock are always computed from the Merchant’s own catalog data, never invented by the AI. The Service also includes a merchant dashboard for catalog management, order tracking, and — where a human needs to step in — direct takeover of a conversation.
4. Merchant accounts and responsibilities
- You must provide accurate business, catalog, and pricing information, and keep it up to date. The Service acts on your behalf using the data you supply.
- You are responsible for the security of your account credentials and for all activity under your account.
- You are responsible for having a lawful basis to message your customers, for complying with the messaging platform’s (e.g. Meta’s) commerce and messaging policies, and for informing your customers that an AI assistant may handle their messages.
- You are responsible for fulfilling orders placed through the Service — the Service facilitates the conversation and transaction record, but delivery, product quality, and customer service for a specific order are the Merchant’s obligation.
- You must not use the Service to sell illegal goods or services, to send spam or unsolicited bulk messages, or in any way that violates applicable law or the messaging platform’s policies.
5. Payments and billing
Merchant subscription fees and any usage-based charges are billed as described at checkout or in your account’s billing settings, processed through our third-party payment processor (Stripe). Where the Service processes an End Customer’s payment for an order (e.g. card or mobile money), that payment is handled by the relevant payment processor under its own terms; Witskorecords the transaction but is not the merchant of record for the underlying sale between the Merchant and their End Customer.
6. AI-generated responses
The AI assistant generates conversational responses based on the Merchant’s catalog and conversation context. While pricing and order totals are always computed deterministically from real catalog data rather than generated by the AI, conversational text itself is AI-generated and may occasionally be imprecise. The Service includes a human-takeover feature precisely so a Merchant can correct or step into any conversation.
7. Third-party platforms
The Service integrates with third-party platforms — including Meta’s WhatsApp Business Platform and Instagram Messaging, and payment processors such as Stripe and mobile money providers. Your use of those integrations is also subject to each platform’s own terms. We are not responsible for outages, policy changes, or account actions taken by those third parties.
8. Data and privacy
Our collection and use of information is described in our Privacy Policy, which forms part of these Terms. See our Data Deletion page for how to request removal of your data.
9. Termination
You may stop using the Service and disconnect your messaging channels at any time from your account settings. We may suspend or terminate an account that violates these Terms, poses a security risk, or is required by a messaging or payment platform’s own enforcement action. Upon termination, outstanding fees remain due, and we will handle any remaining data as described in our Privacy Policy.
10. Disclaimers and limitation of liability
The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation, particularly where a dependency is a third-party platform outside our control. To the maximum extent permitted by law, Witsko is not liable for indirect, incidental, or consequential damages arising from use of the Service, including losses relating to a specific order, delivery, or third-party platform outage.
11. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the Service after a change constitutes acceptance of the updated Terms.
